The Kentucky Consumer Data Protection Act (KCDPA) provides Kentucky residents greater control over their personal data while imposing several compliance obligations on businesses. Modeled after similar state-level legislation, the KCDPA outlines key consumer rights, including confirmation and access to personal data, correcting inaccuracies, deleting personal data, obtaining a copy, and opting out of targeted advertising, selling personal data, or profiling. 

The KCDPA applies to businesses that operate in Kentucky and manufacture goods or services aimed at Kentucky residents. It pertains to persons that, during a calendar year, control or process the personal data of at least 100,000 consumers; or 25,000 consumers, and receive more than 50% of their gross revenue from the sale of personal data.

The KCDPA imposes several obligations on businesses, including obtaining consent, ensuring data minimization, ensuring transparency through mandatory privacy notices, requiring businesses to implement strong data security measures, being nondiscriminatory, and conducting data protection impact assessments.
