The Qatar Financial Centre (QFC) issued the QFC Data Protection Regulations 2021 (Regulations) on December 21, 2021. These Regulations went into effect on 19 June 2022 and placed the responsibility on those who collect, hold and process personal data while giving rights to the people whose data is collected. Furthermore, these Regulations define specific principles and obligations with which data controllers and data processors must comply.

These Regulations apply to the processing of personal data by a data controller or data processor incorporated or registered in the QFC. QFC Data Protection Regulations also apply to the processing of personal data by a data controller or data processor that is not incorporated or registered in the QFC, if that data controller or data processor processes personal data through a data controller or data processor that is incorporated or registered in the QFC.

Key Rights Under QFC Data Protection Regulations 2021

Like most data protection regulations, the QFC Data Protection Regulations 2021 also provide users with a wide array of rights over their data, better known as data subject rights. These include:

Right to Access

All data subjects have the right to know from the data controller if any of their personal data is being processed. If so, the data subject must be given access to all such data collected and the information as described in the law.


Right to Rectification

All data subjects have the right to request rectification of any and all personal data collected that is inaccurate/incomplete/outdated. The data subject must provide a supplementary statement to complete any personal data that is incomplete.


Right to Erasure

All data subjects have the right to request the erasure of any and all personal data collected by the data controller. In the appropriate circumstances, the data controller must honor such a request without undue delay.


Right to Object

All data subjects have the right to object to processing their personal data. Additionally, the data subject can object to processing their personal data for direct marketing purposes. In such cases, the data controller must cease the processing of the data subject's personal data without undue delay.


Right to Restriction of Processing

All data subjects have the right to request a data controller to restrict the collection of their personal data.


Right to Data Portability

All data subjects have the right to receive any and all personal data collected on them by the data controller in a structured, commonly used, and machine-readable format.


Right to Object to Automated Decision-making

All data subjects have the right not to be subjected to a decision that is based solely on automated processing, including profiling if the decision would have a legal effect on them or would otherwise significantly affect them.

Here are some important facts to know about the QFC Data Protection Regulations 2021:

The QFC Data Protection Regulations 2021 establishes the Data Protection Office, which holds power to carry out data protection audits, obtain access to any data controller and processor's data processing equipment and means, issue reprimands to data controllers and processors, and impose a temporary or permanent limitation.

The maximum penalty allowed in the event of non-compliance with the Regulations is $1.5 million per offense.

Any data subject that suffers material or non-material damage due to an infringement of these regulations has the right to receive compensation from the data controller or data processor responsible for the damage suffered.

These regulations do not apply to natural persons during their purely personal or household activities.
