Quebec’s Act Respecting Health & Social Services Information (AHSSS) establishes a standard meant to protect individuals' health and social services information while allowing the bodies holding the data to continue using such information in a safe and consented-to manner. 

Among other things, the AHSSS provides a specific definition of what qualifies as “health information”, gives individuals the right to access and request rectifications to their data while also gaining transparency into which other bodies have had access to their information, establishes penalties ranging from $1,000 to $150,000 based on various circumstances, and establishes a new position of “delegated manager of government digital data for the Ministry of Health and Social Services”  who manages authorizations for access to health and social services information.

Key Rights Under Quebec’s AHSSS

Right to Access: All individuals have the right to be informed of the existence of and access to information related to them held by a body. However, this right is not applicable if a health body determines such access would seriously harm the individual’s health.

Right to Rectification : All individuals have the right to request rectification of the information held on them by the body if they know it has become inaccurate, incomplete, or obsolete since its collection or if it was collected or is kept in contravention of the law.

Right to Access Information of Person Being Cared For : A person responsible for the care of another individual has the right to know about the existence of and access to information belonging to that individual, provided such information is necessary for them to exercise their power and responsibilities.

The AHSSS establishes a governance framework based on transparency, accountability, and responsible information usage by service providers and health institutions;

Health institutions using digital services must ensure the highest privacy settings by default, protecting sensitive data;

Individuals can restrict access to their information by specific service providers.

Health services cannot be denied to a person who refuses to consent to the use or communication of their health information;

If health data is to be shared outside Québec, a privacy impact assessment (PIA) must be carried out beforehand;

The Director of Criminal and Penal Prosecutions and law enforcement agencies can access health data if needed for legal proceedings;

In case a decision affecting an individual is made using AI or automated processing, they must be informed and given an opportunity to challenge it;

The Commission d’Accès à l’Information (CAI) oversees compliance, investigates violations, and can impose corrective measures or penalties;

Violations can result in penalties ranging from $1,000 to $150,000, with higher fines for repeat offenses.
