North and South America Jurisdiction

1. Illinois Governor Signs Bill Restricting Predictive Data Use in Employment and Credit Decisions

Date: 9th August, 2024
Summary: On August 9, House Bill 3773 was signed into law, amending the Illinois Human Rights Act to restrict the use of predictive data analytics in employment and credit decisions. The bill prohibits employers and credit assessors from using race or zip code as proxies for rejection. It also requires entities analyzing the creditworthiness of over 50 Illinois residents annually to ensure such factors are not used in adverse decisions. Violations are deemed unlawful under the Act. EU Jurisdiction

2. The Council For European Union Issues Decision Authorizing AI & Human Rights Framework Convention

Date: 29th August, 2024
Summary: The Council of the European Union (the Council) has issued a decision authorizing the signing of the Framework Convention on Artificial Intelligence and Human Rights, Democracy and the Rule of Law (the Convention) as adopted by the Council of Europe (CoE).

This Convention will be implemented across the EU via the EU’s AI Act and other relevant EU regulations, which include the following:

  • Legal acts which aim to implement fundamental rights enshrined in the Charter of Fundamental Rights of the European Union;
  • The General Data Protection Regulation (GDPR); and
  • The Digital Services Act (DSA).

Moreover, the Council stated that the conclusion of the Convention may affect common EU rules or alter their scope.

AI systems related to protecting national security interests will be excluded from the scope of the Convention.

The Council further stated that coordination with the member states should be ensured through the number of votes attributed to the EU or through the possibility for them to accede to the Convention during the negotiation of the Rules of Procedure of the Conference of the Parties. Additionally, the Council has reiterated that the EU and its member states should be able to continue playing their direct and active role in expressing the EU's voice and defending its interests.

Lastly, the Council stated that the Commission must ensure the timely signing of the Convention subject to its conclusion. Read more.

3. PCPD Introduces AI Model Personal Data Protection Framework for Directors

Date: 12th August, 2024
Summary: On August 7, 2024, the Office of the Privacy Commissioner for Personal Data (PCPD) introduced an AI Model Personal Data Protection Framework for Directors. It is meant to guide compliance with the Personal Data (Privacy) Protection Ordinance when using AI.

Its major recommendations include the following:

  • Top management should be actively involved in developing an AI governance strategy that appropriately addresses privacy and security obligations with AI suppliers;
  • Regular and thorough risk assessments must be conducted throughout the AI lifecycle;
  • Appropriate measures should be taken to minimize personal data usage during AI customization and implementation;
  • Consistent communication must be maintained with all relevant stakeholders and regular  feedback should be sought. Read more.

4. New Australian Policy Offers Guidance On Responsible Adoption of AI in the Government

Date: 16th August, 2024
Summary: The Australian government has published its policy on the responsible use of AI in government. The policy contains useful guides for public services on how to safely adapt AI, and strengthen public trust via transparency. It includes the following:

  • Training staff on AI specific to their roles.
  • Publicly outlining AI adoption approaches, including compliance and risk management.
  • Designating officials to oversee policy implementation and stay updated on AI developments.
