Under the Act, consent must be current, explicit, informed, voluntary, and provided by an individual who is able to express their choice. Consent may be implicit (fairly inferred from the circumstances) or express (expressed explicitly, as in a written or verbal agreement).

The maximum penalties for individuals (non-corporate entities) are up to $2.5 million. For bodies corporate, it is greater than $50 million; three times the value of any benefit obtained directly or indirectly from the contravention; or 30% of the body corporate's adjusted turnover during the breach turnover period.

The GDPR mandates consent to be explicit, informed, and unambiguous. In contrast, the Australian Privacy Act distinguishes between express consent (clearly given) and implied consent (reasonably inferred).
