Annex V: EU Declaration of Conformity | EU AI Act

The EU declaration of conformity, referred to in the main AI Act text, should contain the following information:

  • The AI system name, type, and any other additional information that may lead to the identification and traceability of the AI system in question;
  • The name and address of the provider or their authorized representative;
  • A statement declaring that the EU declaration of conformity has been issued under the sole responsibility of the provider;
  • A statement declaring that the AI system is in full conformity with the AI Act’s provisions as well as any other relevant Union laws where a declaration of conformity may be required;
  • A statement that the AI system complies with Regulations (EU) 2016/679 and (EU) 2018/1725 and Directive (EU) 2016/680 if the AI system involves the processing of personal data;
  • References to all relevant harmonized standards used as well as any other common specification for which the conformity is declared;
  • Wherever applicable, the name and identification of the notified body, description of the conformity assessment procedure performed, and the identification of the certificate issued;
  • The time and place of the declaration’s issuance, the name and function of the person who signed it, and an indication of who or on behalf of whom a signature was signed.
