Article 44 of the AI Act provides helpful information related to certificates issued for AI systems.
All certificates issued by notified bodies per Annex VII must be written in a language easily understandable by relevant authorities in the Member State where the notified body is established.
All certificates issued will be valid for the period indicated, which may be at most five years for the AI systems covered by Annex I and four years for those covered by Annex III. At the provider's request, the validity of certificates may be extended further for five years for AI systems covered by Annex I and four years for those covered by Annex III based on a re-assessment in line with conformity assessment procedures. Any amendment to existing certificates will be valid as long as the certificate it supplements remains valid.
If a notified body discovers that an AI system is no longer compliant with the requirements set out in this Regulation, it must suspend or withdraw the certificate issued or impose relevant restrictions, taking into account the principle of proportionality, unless compliance with such requirements can be ensured by corrective actions taken by the system provider within a deadline set by the notified body.
The notified body must provide the rationale for its decisions. Furthermore, a mechanism for appealing decisions, including those related to issued conformity certificates, shall be made available.
