Article 34: Operational Obligations of Notified Bodies | EU AI Act

Published August 15, 2024

Article 34 of the AI Act provides information on the various operational obligations of notified bodies.

All notified bodies are required to verify the conformity of high-risk AI systems per the procedures set out under Article 43. Furthermore, the notified bodies must avoid unnecessary burdens for providers when conducting their activities and should take into account the size of the provider, the sector in which it operates, its structure, and the degree of complexity of the high-risk AI system being assessed to mitigate its potential administrative burdens and compliance costs.

Furthermore, the notified bodies must produce and submit all relevant documentation to the notifying authority per Article 28 to allow the authority to conduct its own assessment, designation, notification, and monitoring activities while also facilitating the assessments to be performed as per this Article.
